Advertisers and members of the public responding to advertisements on our Internet sites
Using of or continued use or proceeding the placing of advertisements on any Where On Earth site signifies your acceptance of these terms and conditions.
A. Members of the public
  1. USE OF WEB SITE
    Use of any Where On Earth member web sites ('the Sites') is subject to these terms and conditions. If you do not agree to these conditions after reading them please stop using the Site immediately. These terms are a legal agreement between Where On Earth, the advertiser and or member of the public and can only be modified with our consent. We reserve the right to change the terms and conditions at our discretion by changing them on the Site.
  2. ACCURACY OF INFORMATION
    Where On Earth reproduces photos of properties and details relating to them on our sites that are supplied to us by the owners of the properties or their agents. We rely on the owners or their agents to update or correct information on these sites which we publish in good faith. If you believe any information on the Site to be inaccurate, please advise us immediately and we will investigate and correct if necessary as soon as possible. However, it is your responsibility to make relevant enquiries with the owners or their agents before renting (or buying) any of the properties advertised.
    Where On Earth accepts no liability and offer no warranties in relation to it and its content to the fullest extent that such liability can be excluded by law.
  3. COPYRIGHT
    These sites contains copyright material, trade names and other proprietary information, including, but not limited to, text, software, photos, graphics. The entire contents of the sites are protected by copyright law, the data protection act 2000 or the database right. Where On Earth own the copyright and/or database right in the selection, co-ordination, arrangement and enhancement of the content of theses sites.
    You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part except as provided in these Terms.
    You may download information from the Site for your own personal use only. You acknowledge that you do not acquire any ownership rights by downloading copyright material.
    The standards of accommodation advertised on all Where On Earth sites are monitored by World One Call. No owner or agent should offer alternative accommodation or refer you to another owner or agent who is not advertising on a Where On Earth site or being monitored by World One Call. Failure to comply with this advice means you are leaving our site and we take no responsibility for, and give no warranties, guarantees or representations in respect of accommodation that is not advertised by Where On Earth or monitored by World One Call.
  4. OUR LIABILITY
    Where On Earth provides the information on all web sites free of any access charge with the exception of Rapport Club International. The information provided on these sites is provided on the basis of Where On Earth Ltd, its subsidiaries, affiliates, partners and networked sites having no liability for the information given.
    In no event shall we be liable to you for any direct or indirect or consequential loss, loss of profit, revenue or goodwill arising from your use of these sites or information on these sites.
    Any opinions, advice, statements, services, offers, or other information or content expressed on these site are those of the owners of the properties or their agents and not the responsibility of Where On Earth.
    We do not endorse or recommend any of the properties on our Site. The information does not constitute any form of advice or recommendation by us and is not intended to be relied upon by you in making (or refraining from making) any decision to rent or buy a property.
  5. LETTING OR PURCHASE OF PROPERTIES
    Any contract for the letting or purchase of any of the properties on these sites or any other product or service advertised on the site is between you and the owner or agent of the property.
    If you make an arrangement with any of the owners or their agents, this is at your sole risk.
  6. LEGAL JURISDICTION AND DISPUTE RESOLUTION
    English law shall apply to these terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. The place of performance shall be England.
B. Advertisers
  1. CONTENT OF ADVERTISEMENTS
    Where On Earth accepts advertisements in good faith and expects that advertisers will provide an accurate description of their property.
  2. All advertisements should comply with relevant UK legislation including the Trade Descriptions Act 1968 (which covers false descriptions) and the Consumer Protection Act 1987 (which covers misleading prices). The advertiser agrees to indemnify Where On Earth against all claims costs arising out of any misleading information in the advertisement.
  3. Where On Earth will take every care to reproduce faithfully the text, prices, contact details and photographs provided to us by advertisers. We will not however be held liable for any loss arising out of any error or omission on our part.
  4. Where On Earth reserves the right to determine the design and layout of advertisements, and (at our discretion) make alterations to submitted text or photographs, should we consider any to be necessary. Where On Earth will not be held liable for any loss arising out of such alterations.
  5. MATERIALS AND PHOTOGRAPHS
    Where On Earth will take the utmost care of all materials and photographs provided for the preparation of advertisements, but cannot be held liable for any loss or damage however caused.
  6. COPYRIGHT
    It is the responsibility of the advertiser to ensure they have the right to reproduce any photographs or digital images which they supply to us. The advertiser agrees to indemnify Where On Earth against all claims costs arising out of any infringement of copyright for such photographs or images.
  7. All digital images produced by Where On Earth from photographs supplied by advertisers are the property of Where On Earth, and shall not be reproduced without our permission.
  8. LIABILITY
    Where On Earth cannot be held liable for any loss or damages howsoever incurred, including consequential losses such as lost income, in connection with advertising on any Where On Earth web site.
  9. STANDARDS OF ACCOMMODATION
    The owner or their agent shall ensure that the accommodation advertised is clean and in a fully habitable and acceptable condition and make every effort to ensure that World One Call is informed of the condition of the property by the departing holidaymaker. http://www.worldonecall.com/essential_advice.htm
    The owner or their agent accepts the terms and conditions laid down by World One call and will if necessary allow access to the property by agents or representatives of World One Call in the event of complaint. http://www.worldonecall.com/feedbackform.php
  10. EXCHANGING PROPERTIES
    Each advertisement relates to a particular property which is given a unique reference number. It is not allowable to substitute a different property by changing the text and photographs on an advertisement.
  11. MAINTAINING ACCURATE AVAILABILITY
    Where On Earth expects all advertisers to update their availability the moment it changes or at least once a week, even if their has been no change. Advertisers are expected to maintain the professionalism of Where On Earth by ensuring that holidaymakers do not waste their time with unnecessary emails and telephone calls about properties that are already booked for the weeks in question.
  12. In the event of an advertiser receiving an enquiry for weeks they have already let from any other source, the advertiser should immediately refer the enquirer to World One Call and provide all assistance and contact details of the relevant World One Call service.
  13. Under no circumstances should an advertiser refer a member of the public to another property owner not advertised with Where On Earth or monitored by World One Call nor offer alternative accommodation not advertised by Where On Earth or monitored by World One Call.
  14. REFUSAL, TERMINATION OR WITHDRAWAL OF ADVERTISING
    Where On Earth reserves the absolute right to refuse to accept any advertisement submitted. If the advertisement has been paid for on-line a full refund will be made, or if a cheque has been received by post this will be returned. Any materials submitted by post will not be returned unless a stamped and addressed envelope has been provided. Under no circumstances will any compensation be payable by Where On Earth for any loss howsoever incurred, including loss of income, the time/cost involved in submitting the advertisement etc.
  15. If Where On Earth receives a complaint about a property, we reserve the right to remove that property from our web site without notice, if in our opinion of World One Call, the complaint is reasonably substantiated. Such complaints could relate to the accuracy of an advertisement, the condition or maintenance of the property, unacceptable booking conditions or procedures, lack of adequate response to complaints etc. In all cases our decision will be final. A refund may be made pro-rata for the remaining unused period of the advertisement, however under no circumstances will any compensation be payable by Where On Earth for any loss howsoever incurred, including loss of income, re-advertising costs etc.
  16. On receipt of an application, Where On Earth will endeavour to process the details within 24 hours of receipt. The advertisement will appear on all-appropriate Where On Earth sites within 24 hours of receipt of payment. The 12 month advertising period will commence from the date the advertisement goes live.
  17. Completion of the application form by the advertiser will be deemed to be the advertisers acceptance of our terms and conditions. The processing of the application form by Where On Earth will be deemed to be our acceptance of the advertisement. Payment by the advertiser will be required not withstanding once Where On Earth have processed the application.
  18. The advertiser may choose to withdraw their advertisement from the Where On Earth web site at any time - please notify us in writing (letter or e-mail). They may also request that that their advertisement is reinstated at any time during the period of advertising purchased. Please note that the period of advertising will not be extended to allow for the time when the advertisement was not showing on the web site. No refund will be made for any advertisement that is withdrawn by an advertiser.
  19. LEVEL OF SERVICE
    Where On Earth will make every effort to provide advertisers with a first class service. We will endeavour to approve new advertisements, and approve changes to existing advertisements as quickly as we possibly can. However, as we have no control over the number of requests that we receive at any time, we are unable to guarantee response times.
  20. Where On Earth will endeavour as far as practical to ensure that the web sites are available on the internet at all times. However some breaks in service are inevitable and often beyond our control, we are therefore unable to guarantee 100% up time.
  21. Where On earth guarantee to include all advertisement on all new pertinent web sites as and when new sites join the Where On Earth Group. This will be done for the advertising period and at no additional charge.
  22. Where On Earth also guarantee to provide other alternative advertising sources to all Where On Earth advertisers through all Where On Earth search engines, networks and search directories at no additional charge.
