Typically he looks at issues from several angles. In the case of one the most alarming consequences of debt - the possible repossession of your home - he deals with scenarios that include the following.

  • The 'little-known strategy' of changing from homeowner to tenant by selling your home to your local housing association, to which you then pay rent. You subsequently have the chance to buy your home back. Such schemes exist, he says, but are rare. However, it's worth checking with your local authority.

  • Selling your home yourself, an option that has both advantages and disadvantages and which is not always desirable - or even necessary!

  • Repossession proceedings are begun by your mortgage lender - how you proceed before the hearing and in Court.

  • Your home is actually repossessed and your mortgage lender resells the property. On the one hand you may have rights of appeal while on the other hand you may have further problems later if the new selling price is lower than your original loan.

Probably even more alarming than the loss of your home is the risk of going to prison - something which is unlikely but is, as we have seen, a possible consequence of priority debts. Here are some of the areas covered by Keen in his chapter on bailiffs and imprisonment.

  • Debt collectors and bailiffs are different, Keen points out, and debt collectors ought not to claim bailiffs' powers.

  • There are circumstances under which you can prevent bailiff action.

  • You have certain powers regarding bailiffs' right of entry into your home.

  • There are goods which cannot rightfully be seized.

  • There are misleading arguments used by bailiffs to gain entry into your home.

  • However unlikely imprisonment may be, it can be a realistic outcome under certain circumstances. A court is more likely to sentence you for non-payment of e.g. council tax or maintenance if it believes you are refusing to pay rather than unable to pay.
